The penalty stems from Mobil promoting "contains 10% ethanol" E10 fuel on gas station signage, while some of the fuel actually sold did not meet the promised ethanol content standard. Regulators pointed out that such behavior could mislead consumers' choices and environmental commitments, emphasizing that companies must ensure the accuracy of their marketing statements. The settlement agreement also includes Mobil's commitment to strengthen internal compliance reviews to prevent similar incidents from happening again.
